1. Acceptance of terms

By accessing or using the Zaina AI platform at zaina.ai ("Platform"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree, do not use the Platform.

These Terms constitute a binding agreement between you and The Agile Monkeys ("we", "us", "our"), the company operating the Zaina AI brand.

Zaina AI is an informational platform. We are not a clinic, hospital, medical practice, or any form of healthcare provider. We are not regulated as a medical service under any applicable law.

3. Who may use the Platform

You may use the Platform only if:

• ●You are at least 18 years of age.
• ●You have the legal capacity to enter into a binding agreement.
• ●Your use complies with all applicable laws in your jurisdiction.

The Platform is not intended for individuals under 18. If you are under 18, do not use this Platform.

4. Description of the service

Zaina AI provides:

• ●Informational responses about aesthetic medicine and plastic surgery procedures, including techniques, recovery, risks, and what questions to ask a surgeon.
• ●Guidance to help you formulate informed questions for your medical consultations.
• ●Clinic referrals to Zaina Verified partner clinics and surgeons (with your explicit prior consent).
• ●Market intelligence to partner clinics in the form of aggregated, anonymised demand reports derived from platform conversations.

Zaina AI does not provide:

• ●Medical diagnoses of any condition.
• ●Personalised surgical recommendations based on your health status.
• ●Prescriptions or clinical instructions.
• ●Guarantees of outcomes from any procedure or surgeon.
• ●Emergency medical assistance. If you are in a medical emergency, contact emergency services immediately.

5. How conversation data is used

When you use the Zaina AI chat, your conversation is retained. You should be aware of the following:

• ●Your conversation text is stored for up to 24 months for internal demand analysis and to generate anonymised market intelligence reports for partner clinics.
• ●Your conversation is not linked to your identity unless you separately provide contact details to request an appointment.
• ●Your conversation is not used by The Agile Monkeys to train AI models or improve the RAG knowledge base. Conversation data is transmitted to our LLM provider (Anthropic Inc.) for response generation only, subject to their Data Processing Agreement and privacy policy at privacy.claude.com/en/articles/10458704.
• ●Anonymised, aggregated trends (not individual conversations) from platform usage are shared with partner clinics as market intelligence (e.g. most searched procedures by category).

Chat conversations are stored without linkage to your identity and do not constitute sensitive personal data under the PDPL. Processing is carried out on the basis of legitimate interest for the provision of the informational service. Explicit consent is collected separately if you choose to request an appointment. 6. Appointment requests and clinic referrals

If you choose to request an appointment with a partner clinic:

• ●You will be asked to provide your name, contact details, and the procedure type you are interested in.
• ●This information is collected and stored separately from your chat history.
• ●The only connection between your appointment record and your chat is the procedure category (e.g. "liposuction" or "facial peel") — your full conversation is not shared with the clinic.
• ●Your contact details are shared with the specific partner clinic for the purpose of scheduling your consultation.
• ●We receive a referral fee from partner clinics for confirmed procedures. The informational content of the assistant is generated from a fixed knowledge base and is not modified or customised based on commercial relationships with any clinic.
• ●The clinic's own terms and privacy policy will apply to your relationship with them from the point of contact onwards.

Referral is always subject to your explicit, prior consent. You may use the informational service without ever requesting an appointment.

7. Zaina Verified clinics

The 'Zaina Verified' designation indicates that a clinic or surgeon has been reviewed and listed by Zaina AI as a partner confirmed to offer aesthetic medicine or plastic surgery services, with verified contact details and location information. It is an informational listing only. It does not constitute:

• ●A medical endorsement or clinical accreditation by any regulatory body.
• ●A guarantee of surgical outcomes.
• ●A warranty of the clinic's current status, active licensing, or availability.

We recommend that you independently verify the credentials and current licensing of any clinic or surgeon before scheduling a consultation or procedure.

8. AI-generated content — limitations

You acknowledge that:

• ●AI-generated content may contain errors, omissions, or outdated information.
• ●The assistant cannot assess your individual health status, medical history, or suitability for any procedure.
• ●Responses are general in nature and do not constitute personalised medical advice.
• ●You should always verify information with a qualified medical professional before making any decision.

We maintain a knowledge base of general information about aesthetic medicine and plastic surgery procedures. Content is periodically reviewed for factual consistency with publicly available medical literature.

9. Acceptable use

You agree to use the Platform only for lawful purposes. You must not:

• ●Use the Platform as a substitute for professional medical consultation or emergency care.
• ●Submit false, misleading, or fraudulent information.
• ●Attempt to reverse engineer, scrape, or extract data from the Platform or its knowledge base.
• ●Use automated tools (bots, crawlers) to access the Platform without authorisation.
• ●Attempt to circumvent security or access controls.
• ●Use the Platform in any way that could damage its reputation, operation, or the interests of partner clinics.
• ●Impersonate any person or entity.

10. Intellectual property

• ●All content on the Platform — including text, design, logo, AI responses, and the "Zaina Verified" mark — is the exclusive property of The Agile Monkeys or its licensors.
• ●You may not reproduce, distribute, modify, or create derivative works from any Platform content without our prior written consent.
• ●The names "Zaina", "Zaina AI", "Zaina Verified", and "The Intelligence of Beauty" are trademarks of The Agile Monkeys. Unauthorised use is prohibited.

11. Limitation of liability

To the maximum extent permitted by applicable law:

• ●We provide the Platform "as is" and "as available" without warranties of any kind.
• ●We are not liable for any decision you make based on information provided by Zaina AI.
• ●We are not liable for any medical outcome, surgical result, or complication arising from a procedure at a partner clinic.
• ●We are not liable for the acts, omissions, or quality of service of any Zaina Verified clinic or surgeon.
• ●We are not liable for losses arising from inaccurate, incomplete, or outdated AI-generated content.
• ●Our total aggregate liability to you for any claim arising from these Terms or your use of the Platform shall not exceed SAR 500 (five hundred Saudi Riyals).

Nothing in these Terms excludes liability for fraud, wilful misconduct, death, or personal injury caused by our negligence.

12. Indemnification

You agree to indemnify and hold harmless The Agile Monkeys, its directors, employees, and agents from any claims, losses, damages, or expenses (including reasonable legal fees) arising from your violation of these Terms or your misuse of the Platform.

13. Third-party links and services

The Platform may link to third-party websites (clinics, hospitals, or external resources). We have no control over and take no responsibility for the content, privacy practices, or accuracy of any third-party site. Visiting those sites is at your own risk.

The Platform is built and hosted on Lovable (Lovable Labs Inc.) infrastructure. AI responses are generated via the Claude API provided by Anthropic Inc. Both act as data processors under Data Processing Agreements. Their respective privacy policies apply to their processing activities: lovable.dev/privacy and privacy.claude.com/en/articles/10458704.

14. Service availability

We do not guarantee that the Platform will be available at all times. We may suspend or discontinue the service, or modify its features, at any time. We will make reasonable efforts to minimise disruption and provide advance notice where possible.

15. Modifications to these Terms

We may update these Terms at any time. We will notify registered users of material changes by email or site notice at least 15 days before they take effect. Continued use of the Platform after the effective date constitutes acceptance of the revised Terms.

16. Governing law and jurisdiction

These Terms are governed by the laws of the Kingdom of Saudi Arabia. Any dispute arising from these Terms shall be subject to the exclusive jurisdiction of the courts of Riyadh, Saudi Arabia.

17. Severability

If any provision of these Terms is found to be invalid or unenforceable, it shall be modified to the minimum extent necessary to make it enforceable. The remaining provisions shall continue in full force and effect.
